Welcome to Green Haven ("Company", "we", "us", "our"). These Terms of Service ("Terms") govern the relationship between Green Haven, led by founder Luke Powell, and our clients ("Client", "you", "your") for all landscape design, groundwork, construction, and installation services across Dorset, Hampshire, and surrounding regions.
By commissioning our services, signing a project proposal, or permitting work to begin, you agree to be bound by these Terms.
Scope of Work & Variations
Specifications: Green Haven will execute the project in accordance with the signed itemised technical proposal and finalised architectural blueprints.
Client Variations: Any changes, additions, or structural modifications requested by the Client after the contract is signed will be treated as a "Variation." Variations must be agreed upon in writing and will incur additional material and labour costs, which will be billed accordingly.
Unforeseen Ground Conditions: Our proposals assume normal ground conditions. If our team encounters subterranean hazards (e.g., buried concrete, hidden utilities, capping rocks, excessive drainage failure) that were not reasonably visible during the initial site survey, any necessary remedial work will constitute a variation and incur additional charges.
Payment Terms & Title of Goods
Deposit: A non-refundable deposit (specified in your proposal) is required to secure your project slot on our build timeline and initiate material sourcing.
Stage Payments: For multi-week installations, a schedule of interim stage payments will be outlined in the contract and must be settled promptly at each milestone.
Final Payment: The remaining balance is due immediately upon practical completion of the project layout.
Retention of Title: All materials, plants, timber panels, aggregates, and structural goods delivered to the site remain the sole legal property of Green Haven until the final project invoice is paid in full.
Limited 3-Month Warranty & Exclusions
Warranty Availability: Green Haven takes immense pride in our craftsmanship. A limited 3-month structural warranty is available on select structural installations (such as paving alignment, timber framing stability, and boundary fencing fittings) from the date of practical completion.
Service Exceptions: Not all services or components carry a warranty. Due to variables completely beyond our control, the following exclusions apply strictly:
Living Elements & Softscapes: We source premium, healthy turf, plants, and specimen trees. However, once installed, the ongoing survival of living elements depends entirely on client care, watering, and weather patterns. Green Haven provides no warranty on turf, grass seeds, or plants against frost, underwatering, overwatering, pests, or neglect.
Client-Supplied Materials: No warranty is provided on structural or decorative materials purchased or supplied directly by the Client.
Natural Wear & Subsurface Shifts: The warranty does not cover natural timber splitting, minor aggregate settlement, storm damage, normal wear and tear, or accidental damage caused by the Client or third-party machinery after our team hands over the site.
Site Access & Client Responsibilities
Access Requirements: The Client must guarantee our team of contractors clear, unobstructed access to the garden site, as well as access to clean water and electricity utilities for the duration of the build phase.
Permissions & Boundary Lines: It is the Client's sole responsibility to secure all necessary planning permissions, property boundary agreements, and neighbor clearances prior to the groundbreaking phase. Green Haven accepts no liability for disputes arising from incorrectly identified boundary lines or unauthorised structural placements.
Liability Limits
Green Haven maintains comprehensive public liability insurance.
We accept no liability for any damage caused to underground pipes, cables, or utilities that were not explicitly disclosed to us or clearly mapped out on official property documentation prior to excavation.
Our total liability for any claim arising out of the project, whether in contract or tort, shall not exceed the total price paid by the Client for the specific service rendered.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with our services shall be subject to the exclusive jurisdiction of the English courts.
